These AI Terms and Conditions ("AI Terms") are supplemental to and form part of the b10cks Terms of Service available at https://www.b10cks.com/legal/terms ("Terms of Service"). Defined terms used but not defined herein have the meaning given to them in the Terms of Service. In the event of a conflict between these AI Terms and the Terms of Service, these AI Terms prevail with respect to the subject matter of AI Features.
By enabling or using any AI Feature within the b10cks Services, Customer agrees to be bound by these AI Terms in addition to the Terms of Service.
1.1. Covered Features. These AI Terms apply to all AI-powered features made available within the b10cks Services ("AI Features"), which currently include:
b10cks may add, modify, or discontinue individual AI Features at any time. The current list of available AI Features will be maintained in the Documentation at https://www.b10cks.com/docs/ai-features.
1.2. Optional Use. AI Features are optional and not required for core use of the b10cks Services. Customer may enable or disable AI Features at any time through the Account settings. Disabling AI Features does not affect Customer's access to the remainder of the b10cks Services.
1.3. AI Features on All Plans. AI Features are available to Customers on all Subscription Plans, including the Free Plan, subject to the AI Credit Allowance applicable to each plan as described in Section 4.
2.1. OpenRouter. b10cks provides AI Features through OpenRouter (operated by OpenRouter, Inc.), an AI model aggregation and routing platform ("AI Provider"). OpenRouter routes Customer requests to one or more underlying large language models or AI models ("AI Models") from third-party model providers (such as Anthropic, OpenAI, Google, Meta, Mistral, and others) depending on the model selected by Customer.
2.2. Model Selection. Customer may select from a list of available AI Models within the b10cks Services. The available models and their capabilities are displayed in the b10cks App and may change over time as b10cks updates its model offering. b10cks does not guarantee the continued availability of any specific AI Model.
2.3. Third-Party Terms. Use of AI Features is subject to the applicable terms and policies of OpenRouter and the underlying model providers. By using AI Features, Customer acknowledges and agrees that:
(a) Customer Content, including prompts, text, and images, is transmitted to OpenRouter and the selected AI Model for processing;
(b) OpenRouter's Terms of Service (https://openrouter.ai/terms) and Privacy Policy apply to the processing performed by OpenRouter;
(c) the terms and acceptable use policies of the underlying AI Model provider also apply; and
(d) b10cks has no control over how OpenRouter or underlying model providers process, store, or handle data once transmitted, beyond any contractual protections in place between b10cks and OpenRouter.
2.4. Data Processing by AI Provider. Customer acknowledges that prompts and Customer Content submitted through AI Features are sent to OpenRouter and the selected AI Model as necessary to generate a response. b10cks will maintain a Data Processing Agreement with OpenRouter to the extent required by the GDPR. Customers should review OpenRouter's privacy documentation to understand how their data is handled at the provider level.
2.5. Model Training. b10cks does not use AI outputs or Customer Content to train or fine-tune any AI models owned or operated by b10cks. Whether an underlying AI Model provider uses submitted data for training purposes depends on that provider's policies. b10cks will use commercially reasonable efforts to engage AI Providers that offer data processing terms excluding the use of Customer data for model training. Customers are encouraged to review the applicable model provider policies for full details.
3.1. Acceptable Use of AI Features. Customer agrees not to use AI Features to generate, process, request, or publish content that:
(a) violates any applicable law or regulation, including Austrian law and applicable EU legislation;
(b) is pornographic, sexually explicit, obscene, or constitutes adult content of any kind;
(c) incites, promotes, or facilitates violence, terrorism, self-harm, or hatred on any basis, including race, religion, gender, sexual orientation, disability, or national origin;
(d) constitutes or facilitates child sexual abuse material (CSAM) or the exploitation of minors in any form;
(e) is intentionally deceptive, constitutes disinformation, or is designed to mislead consumers or the public;
(f) infringes the intellectual property rights, privacy rights, or other legal rights of any third party;
(g) is used to develop, train, or improve any AI model or competing product or service;
(h) is used for automated decision-making in high-risk contexts (as defined under the EU AI Act) without appropriate human oversight and safeguards; or
(i) violates the acceptable use policies of OpenRouter or any underlying AI Model provider.
3.2. Prompt Responsibility. Customer is solely responsible for all prompts, inputs, and instructions submitted to AI Features ("Prompts"). Customer must not include sensitive personal data, special category personal data (as defined under GDPR Article 9), payment card data, or credentials in Prompts unless expressly permitted and appropriate safeguards are in place.
3.3. Human Oversight. Customer acknowledges that AI-generated outputs may be inaccurate, incomplete, biased, or otherwise unsuitable for use without review. Customer is solely responsible for reviewing, validating, and approving all AI outputs before publishing or relying upon them, and for ensuring that AI outputs comply with applicable laws and do not harm any person.
3.4. Compliance with AI Regulation. Customer is responsible for ensuring its use of AI Features complies with all applicable AI-related regulation, including the EU AI Act (Regulation (EU) 2024/1689) and any applicable national implementing measures, to the extent such regulation applies to Customer's use case.
4.1. AI Credits. Access to AI Features is governed by an AI Credit Allowance allocated to each Subscription Plan. AI Credits are denominated in USD and correspond to the cost of AI model usage routed through OpenRouter. Each AI Feature request consumes AI Credits based on the model selected and the volume of input and output tokens or data processed.
4.2. Plan Allowance. The AI Credit Allowance applicable to each Subscription Plan is displayed on the b10cks pricing page at https://www.b10cks.com/pricing and in the b10cks App. b10cks reserves the right to adjust AI Credit Allowances across plans on reasonable notice in accordance with the Terms of Service.
4.3. Credit Consumption. AI Credit consumption per request depends on:
(a) the AI Model selected by Customer — different models carry different per-token or per-request costs;
(b) the length and complexity of the Prompt and the AI output (token volume); and
(c) the type of AI Feature used (writing, translation, or image analysis).
Indicative per-model costs will be made available in the Documentation. Actual consumption may vary.
4.4. Monitoring. Customers can monitor their AI Credit usage in real time through the b10cks App. b10cks will endeavour to notify Customer when usage approaches the applicable AI Credit Allowance threshold.
4.5. Exhaustion of Allowance. If Customer exhausts its AI Credit Allowance before the end of the applicable Billing Cycle, AI Features will be suspended for the remainder of that Billing Cycle. Customers may upgrade to a higher Subscription Plan or purchase additional AI Credits, if made available by b10cks, to restore access. Core b10cks Services remain unaffected by exhaustion of AI Credits.
4.6. No Rollover. Unused AI Credits do not roll over from one Billing Cycle to the next. Unused AI Credits have no monetary value and are not refundable.
5.1. No Ownership Claim by b10cks. b10cks makes no ownership claim over content generated by AI Features ("AI Output"). b10cks does not assert any intellectual property rights in AI Output.
5.2. Customer Responsibility for AI Output. The legal status of AI-generated content — including whether it is capable of copyright protection — is subject to evolving law and varies across jurisdictions. Customer acknowledges that:
(a) AI Output may not be protectable by copyright or other intellectual property rights under applicable law, including Austrian law;
(b) AI Output may resemble or be identical to content generated for other users using similar Prompts, and b10cks does not warrant the uniqueness or exclusivity of any AI Output; and
(c) Customer is solely responsible for determining whether and how AI Output may be used, published, or commercialised, and for any consequences arising from such use.
5.3. Licence for Delivery. To the extent any rights subsist in AI Output, Customer grants b10cks a non-exclusive, royalty-free licence to store, process, and deliver such AI Output solely as necessary to provide the b10cks Services to Customer.
6.1. Nature of AI Outputs. AI Features are powered by probabilistic language and vision models. b10cks does not warrant that AI Output will be accurate, complete, appropriate, free from bias, legally compliant, or fit for any particular purpose. AI Output may contain factual errors, hallucinations, or content that is outdated, offensive, or inconsistent.
6.2. No Professional Advice. AI Output does not constitute legal, medical, financial, regulatory, or any other form of professional advice. Customer must not rely on AI Output as a substitute for qualified professional judgment.
6.3. Image Analysis Limitations. The AI Image Analysis feature generates automated descriptions and tags for images. Such outputs are inherently approximate and may be inaccurate, incomplete, or culturally inappropriate. Customer must review all image analysis outputs before use, particularly in contexts where accuracy is critical (e.g. accessibility metadata, commercial listings).
6.4. Translation Limitations. AI Translation outputs are machine-generated and may not reflect the nuance, terminology, or register of professional human translation. Customer is solely responsible for reviewing translated content before publication, particularly in regulated, medical, legal, or safety-critical contexts.
6.5. Service Availability. AI Features depend on the availability of OpenRouter and the selected AI Model. b10cks does not guarantee the availability, performance, or response times of AI Features and does not include AI Feature availability within the scope of the 99% Uptime Commitment in the Terms of Service. Interruptions to AI Features do not constitute a breach of the Uptime Commitment and do not give rise to service credits.
7.1. Personal Data in Prompts. To the extent Customer submits personal data as part of a Prompt or Customer Content processed through AI Features, Customer acts as the data controller and b10cks acts as a data processor. Processing of such data is subject to the b10cks Data Processing Agreement at https://www.b10cks.com/legal/dpa.
7.2. Sensitive Data. Customer must not submit special category personal data (including health, biometric, religious, political, or sexual orientation data) through AI Features unless Customer has: (a) a lawful basis for such processing under GDPR Article 9; (b) notified affected data subjects; and (c) ensured that the selected AI Model and OpenRouter provide adequate safeguards for such data.
7.3. Data Minimisation. Customer is encouraged to minimise the personal data included in Prompts and to anonymise or pseudonymise data where feasible before submitting it to AI Features.
7.4. EU AI Act Compliance. b10cks will use commercially reasonable efforts to ensure that AI Features, as provided by b10cks, comply with applicable obligations under the EU AI Act. Customer is responsible for its own compliance obligations as a deployer of AI systems under applicable law.
8.1. Additional Exclusions. In addition to the limitations set out in Section 12 of the Terms of Service, b10cks is not liable for:
(a) any loss or damage arising from Customer's reliance on AI Output without adequate human review;
(b) any intellectual property infringement claim arising from AI Output generated in response to Customer's Prompts;
(c) any inaccuracy, bias, or error in AI Output, including incorrect translations or image descriptions;
(d) the acts or omissions of OpenRouter or any underlying AI Model provider; or
(e) any suspension or degradation of AI Features due to the unavailability or changes in OpenRouter's services or any AI Model.
8.2. Free Plan AI Liability. For Customers using AI Features on the Free Plan, b10cks's liability in connection with AI Features is excluded entirely to the maximum extent permitted by Austrian law.
9.1. Changes to AI Features. b10cks may add, remove, or modify AI Features, available AI Models, or AI Credit Allowances at any time. Where a change materially reduces the AI Features available to Customer's Subscription Plan, b10cks will provide at least thirty (30) days' prior notice.
9.2. Changes to These AI Terms. b10cks may update these AI Terms from time to time. Material changes will be communicated with at least thirty (30) days' notice in accordance with the amendment provisions of the Terms of Service. Continued use of AI Features after the effective date of any updated AI Terms constitutes acceptance of those changes.

These AI Terms are governed by Austrian law and form part of the Agreement between Customer and Coder's Cantina e.U. In the event of conflict, these AI Terms take precedence over the Terms of Service with respect to AI Features.
